You call your payroll company. You've got a few guys on your crew with ITINs. And the answer comes back: "Sorry, our system can't do that."
No explanation. No next step. Just a no.
We hear this from contractors every week. So let's clear it up.
A lot of large national providers run on systems built around one thing: a Social Security number. If a worker doesn't have one, the system doesn't know what to do. So the answer becomes no, and you're left figuring it out on your own.
That's not a legal answer. That's a software answer.
An ITIN is an Individual Taxpayer Identification Number. The IRS issues it so people who can't get a Social Security number can still file and pay federal taxes.
Here's the part that matters. An ITIN is a tax number. It is not work authorization. Those are two separate questions, and you need to get both right:
Mix those two up and that's where business owners get hurt.
I tell every contractor the same thing. Putting someone on payroll is the easy part. Probably 80 to 90% of this is compliance.
That means:
Get that right and you're protected. Skip it, or pay crews off the books, and you're one audit or one injury away from a very bad year.
A good partner doesn't just say yes or no. They walk you through it. They ask the right questions up front. They tell you what paperwork you need and why.
And when you have a question, you call and a person picks up. In English or in Spanish.
That's what we do at Baron Payroll. We work with construction companies every day, and helping owners handle ITIN workers the right way is a big part of it.

Can I put a worker with an ITIN on payroll? The payroll side can be set up, but an ITIN by itself does not authorize someone to work. Every hire still needs a completed Form I-9. Talk to a payroll provider who handles ITIN situations, and to an employment attorney if you're unsure.
Is an ITIN the same as a Social Security number? No. An ITIN is a federal tax processing number. It doesn't provide Social Security benefits or work authorization.
Why did my payroll company say no? Often it's a system limitation, not a legal ruling. Some providers aren't set up to handle anything outside the standard SSN workflow.
What happens if I just pay ITIN workers in cash? You could be exposed to back taxes, penalties and wage claims, and those workers might not be covered by your workers' comp policy if they get hurt.
Does Baron Payroll offer support in Spanish? Yes. We have Spanish-speaking payroll support for business owners.
